Actually a TOD should apply only if such bids are opening preempts.Take bidding like [hv=d=s&v=0&b=11&a=2hp4hd]133|100[/hv] 4♥ is not an opening bid, and could be quite a good hand expecting 4♥ to make. Double is still for takeout. To compensate, GIB will randomly pass takeout doubles which turns the double into penalty.
