We'd be playing in 1N= by W I suspect playing a weak NT (unless N gets a discard wrong), I'm not sure if I'd reopen with the N hand, you could hardly blame S for passing with plenty of hands where you're not beating it thinking you have an 8 or 9 count and looking for 200, it's safer at teams where -180 is not horrible.

 

Edit: and yes south has a beyond obvious 1 opener (or 1N if playing weak), I can bear to pass the E hand in first seat with the Qx and I'm pretty aggressive here, we open most rule of 19 hands. Over 1 from E I'd overcall 1 with the south hand.

South has a 13 point hand, good spot cards. The KQJ of spades are worth more than just isolated honors. Yes, the club queen and the diamond jack may not be pulling their full weight, but the spades and the nines balance that enough to make this an opener in my book.

 

Yet South could not act in second seat? If you will pass opening bids, then at least some of the time you will not be able to get back into the auction later on. This is especially true for the more balanced hand types. In this case when the bidding gets passed around to North in 2♢, even the 2 level may well seem a bit rarefied for many on that hand. Yes, North has the perfect shape to balance, but it is way easier if South just sees an opening hand, and finds a bid in the first place.

 

It might be interesting to then listen in on the conversation from E-W, about how could THEY be competing in their 9 card diamond fit, after South has opened the bidding 1♢, and NS got to a spade partial.

Sure, but he could take action over pass on the previous round of bidding.

 

E is really strong for 2D unless it is an inverted raise by a passed hand, in which case W can pass with this goodish 12-14 bal minimum but all points in minors. I think I’d bid 1 or even 2NT as E with this scattered collection (and go down due to the foul D break that I can’t guess to pick when on lead with the SA at the 2nd trick).
