Takeout double at second opportunity

If South wanted to make a takeout double, wouldn't he have done it a round earlier? Why isn't this a penalty double? MP, if it matters.

And, if North really thinks this is a take-out double, why didn't he take it out?

 

Note: At some tables, South bid 1N instead of passing over 1H. This created the auction:

P-1H-1N-Dbl

R-2H- P-4H

P- P- *

*when South doubled here, it was again explained as takeout, and passed by North.
