Someone -- I want to say Marvin French -- made up a rule for this situation:

 

"Reopen with a double, unless you have a hand that would have pulled a penalty double by partner."

I would double.

 

However, I think Justin is being overly optimistic when he suggests a 20% chance of a conversion. We hold the heart A, and most opps will hold decent texture and/or a 6 card suit when they make a 2/1 overcall, so I think it unlikely that partner has the hearts to sit for a double, when our classic holding for the double is x or xx.

 

Having said that, 3 is a big bid. I'd rather play 2 opposite a typical 5 - 7 count 2=4=4=3 hand.

 

And we may land on our feet if he bids 3 (tho I'd be more comfortable if I knew that we didn't play a 2 opener as a weak two). Plus the small chance that he has a penalty pass tips the scales on what would otherwise be a close decision.

 

I don't think RHO's pass means much here. The fact that he lacks a heart raise really says very little about partner's holding a penalty pass when we're looking at our values.
