I would think this has a very small risk. The risk is partner might go into the tank over your 5♦ bid then bid 5♥. It is true that if they complained about your 6♥ bid as UI and the director ruled in their favor I would laugh at the director. But, are you seriously thinking you can get to seven? I would think there isn't enough room to find the grand even if partner bids 5♠ so I would favor 6♥ now to avoid the possible unnecessary involvement the director.
