aguahombre Posted August 30, 2009 Report Share Posted August 30, 2009 ACBL here, but interested in all: True or false---An appellant may drop the case for most any reason, but neither an AC nor a director is allowed to fail to act based on the fact that a change would not affect the standings, nor can a director properly state that he will first see whether an adjustment will have any effect before choosing whether to adjust a score. awm Posted August 31, 2009 Report Share Posted August 31, 2009 Related question: Suppose that a committee is deciding whether to rule an appeal to be without substantial merit. In some jurisdictions this involves refusing to return the fee paid by the appealing side. When the committee is making this decision, should the possible effect on the standings be considered? In an extreme case, suppose that the appeal actually reverses the director's table decision. Can the appeal still be ruled without merit if it has no effect on the results/standings of the event in question, and the appealing side could reasonably have known this when filing the appeal? PeterE Posted August 31, 2009 Report Share Posted August 31, 2009 True or false ...True - except that in high level German Tournaments you'll lose 1/3 of your deposit, if you drop an appeal after filing it.But it's an (universal) right of every contestant to appeal a TD's decision at his own table (see Law 92 A) - without any conditions or restrictions. Re related question: No, the AC should (IMO must) not consider the effect on the overall standings.
