North has the right to believe that slam is possible, as South took a freebid over 3♥. Why South did so is anyone's guess. South should double - he doesn't have anything close to a slam bid (or, for that matter, a free 4♣ bid over 3♥). The fact that 5♥ makes does not justify either a 6♣ bid or a pass of 5♥.
