If partner surprised me with a 3♠ bid, my hand is not such a bad dummy. If partner has spades and not enough values to make a negative X that would be very surprising. I suppose it's possible partner has something like 4-4 or 5-4 in the majors and like 8 or 9 points where the opps wouldn't be bidding 4H and partner wouldn't be making a negative X but it's a hard construction to come up with. At least 90 % of the time I would bet partner is about to make a penalty pass. This is where it helps to be at the table so you can feel out your RHO.
