Obviously East doesn't have a takeout double, or even an "opening hand" double. And West's hand is a pretty obvious bid unless double is penalty. Now, whether N/S deserve any protection if E/W didn't alert the penalty double may be a different matter. One could argue that south's pass is a "failure to play bridge" since it seems pretty obvious to bid 1♥ here regardless of the meaning of double. As a "takeout double", 1♦X followed by a pass is clearly a problem as some UI of some sort exist. But there are plenty of people who, believe it or not, do not play takeout doubles. Not good players mind you. not even bad "duplicate players." My mother, for example only plays takeout doubles at the one level. Some of here bridge friends don't play takeout doubles at all. With programs like Bridgebrowser and with dogged determination and myhands, one can find out how this EW pair normally play doubles. If doubles are "penalty" when holding penalty hands and takeout when holding takeout hands, and they get it right, clearly that is documentable and actionable.
